TERMS AND CONDITIONS FOR THE WF EDUCATION WEBSITE

These Terms and Conditions (the “Terms”) govern your use of the WF Education Website (the “Website”), operated by The World Federation of Khoja Shia Ithna-Asheri Muslim Communities (KSIMC) (“TWF”, “we”, “us”, “our”). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Website.

  1. Use of the Website

The Website is intended for use by donors, university students, and office bearers (OBs). The Website is not intended for use by children and children cannot access it.

Authorized administrators can only access the Admin Portal. If you are an administrator, you agree to use the portal in line with the guidelines set by us.

By using the Website, including all pages within the Website and the Admin Portal for administrators, you agree to comply with these Terms and use it only for lawful purposes. If you do not agree to these Terms (including any future updates or modifications), your access may be revoked immediately.

Please note that separate terms and conditions apply to our student loan services, which are distinct from the use of this Website. The terms can be found in the loan application form.

  2. Donor Terms

When making a donation through the Website, we ask that you provide accurate and complete information. You must be at least 18 years old to make a donation or access certain parts on the Website.

All donations made through the Website are securely processed via our donation platform, http://donate.wf. By making a donation, you authorize us to collect the specified amount from your chosen payment method.

Donations are generally non-refundable, except where there has been an error in processing or if required by law. If you believe that there has been an error with your donation, please contact us using the provided contact details.

If you are a UK taxpayer, you may be eligible to claim Gift Aid on your donation. By donating, you confirm that you are a taxpayer and agree to us using your details for Gift Aid purposes. You are required to provide the necessary information for us to claim Gift Aid.

Donors will receive a donation receipt via email for tax purposes, when applicable.

We reserve the right to update donation-related terms at any time, and we may refuse or cancel donations at our discretion, particularly if payment information is inaccurate or if there is a suspicion of fraud.

  3. User Accounts

In order to access certain areas of the Website, including the Admin Portal, you may need to create an account. By doing so, you agree to provide accurate and current information when creating your account and to keep it updated if your details change.

You are responsible for maintaining the confidentiality of your account information, and for all activities that occur under your account. If you suspect any unauthorized access to your account, you must notify us immediately.

  4. User Conduct

By using this Website, you agree to:

    1. Use the Website only for lawful purposes, and in a manner that does not harm, disable, or disrupt its operations or other users.
    2. Not engage in any fraudulent, abusive, or illegal activities.
    3. Respect privacy and rights of others and comply with all applicable laws.
    4. Not engage in any conduct that could damage, disable, or impair the Website or interfere with other users’ access to the Website.
    5. Report any violations of these Terms to us.
  5. Privacy and Data Protection

Your use of the Website is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal data, as well as our Cookie Policy.

By using the Website, you consent to the collection and use of your personal data as described in our Privacy Policy, and to our use of cookies as described in our Cookie Policy.

We retain your personal data only for as long as necessary to fulfil the purposes outlined in our Privacy Policy, or as required by law. Once your personal data is no longer required for these purposes, it will be securely deleted or anonymized.

  6. Intellectual Property

All content on the Website, including text, images, logos, graphics, and software, is owned by TWF or its licensors and is protected by copyright and other intellectual property laws. You may not use, copy, or distribute any content from the Website without our written agreement, except for personal, non-commercial use.

  7. Links to Third-Party Websites

The Website may contain links to third-party websites that are not operated by us. We are not responsible for the content, privacy policies, or practices of these third-party sites. We encourage you to review the terms and privacy policies of any third-party website you visit.

Your use of third-party services is governed by the terms and privacy policies of those third parties. We are not responsible for any issues arising from their services, and we encourage you to review the relevant terms before using those services.

  8. Limitation of Liability

To the extent permitted by law, we will not be held liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data or income, arising from your use of the Website or any donation made through the Website.

While we aim that the Website operates smoothly, we do not guarantee that it will be free of errors, interruptions, or viruses, or that the content provided is accurate or reliable.

  9. Changes to the Terms

We may update these Terms from time to time, particularly in response to changes in our services or legal requirements. When updates are made, the new Terms will be posted on this page, and we will notify you when you next use the Website or access the Admin Portal. The updated Terms may be displayed on-screen, and you may be required to acknowledge them before continuing your use of the Website.

By continuing to use the Website after changes are made, you accept the updated Terms.

  10. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are located outside of the United Kingdom, you agree to submit to the jurisdiction of the English courts, subject to any mandatory consumer protection laws in your home country.

  11. Alternative Dispute Resolution

If you have a complaint or dispute that cannot be resolved through our standard customer service processes, you may use alternative dispute resolution (ADR). ADR involves a neutral third-party who helps resolve disputes without the need to go to court. For ADR services, you can contact The Centre for Effective Dispute Resolution (CEDR) at www.cedr.com. CEDR will not charge you for making a complaint, and if you are not satisfied with the outcome, you can still bring legal proceedings.
